Verbal dismissal

20 Jun, 2024

Should an employee be informed of his dismissal?

Mr. [K] was hired as a sales representative by Legallais on March 4, 2012.

By letter dated February 7, 2019, the employee was dismissed for gross misconduct.

Challenging his dismissal, the employee appealed to the industrial tribunal.

Mr. [K] claims to have been verbally informed of his dismissal, during a telephone conversation with the company’s Human Resources Director, which he attests to by producing two testimonials from colleagues who were present during the conversation, and who heard the terms of the conversation as he had switched on the telephone loudspeaker.
