Is an employee’s time sheet—which does not distinguish between commuting time and work time—accurate enough?

On June 29, 2015, Mr. [S] was hired as a logistics, construction, and real estate manager by the Caisse de réassurance mutuelle agricole du Centre Manche.

On June 7, 2019, the parties signed a mutual termination agreement effective July 17, 2019.

On July 13, 2022, the employee filed a claim with the labor court seeking payment of back wages for overtime, a sum representing the mandatory time off in lieu, the corresponding paid time off, and compensation for undeclared work.

To prove his overtime hours, Mr. [S] submitted a table showing, for each half-day, the start and end times of work, counting his commute time as working time. In his table, this time was not distinguished from the other hours recorded.
